These terms govern your access to and use of the Construway platform and website. Please read them carefully before using our services.
1. Acceptance of Terms
By accessing or using Construway, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you may not use our platform or services. These terms apply to all users, including visitors, registered users, and paying subscribers.
2. Platform Access
Construway grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes, subject to these terms. We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with reasonable notice where practicable.
3. Accounts & Access
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us of any unauthorised use. You agree to provide accurate, complete information when registering and to keep it up to date.
4. Subscriptions & Payment
Access to certain features requires a paid subscription. Subscription fees are charged in advance on a annual basis. You authorise us to charge your designated payment method on each renewal date. If payment fails, we may suspend access to paid features until the account is current.
Pricing may change with 30 days' written notice. Continued use of the platform after a price change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to misuse the platform. Prohibited activities include: attempting to gain unauthorised access to any system; using the platform to transmit malware or spam; reverse engineering any part of the software; or using the platform in any way that violates applicable law or the rights of others.
6. Intellectual Property
All content, software, and technology within the Construway platform is the property of Construway or its licensors. These terms do not grant you any rights in our intellectual property beyond what is explicitly stated. Your data remains yours — you retain full ownership of the project data you upload or create in the platform.
7. Data & Privacy
Our collection and use of personal data is governed by our Privacy Policy. We process personal data as a Data Processor on behalf of your organisation, which acts as the Data Controller. For GDPR-specific information, see our GDPR Compliance page.
8. Limitation of Liability
To the fullest extent permitted by law, Construway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.
9. Termination
Either party may terminate the agreement at any time. If you cancel your subscription, access continues until the end of the current billing period. We may suspend or terminate your access immediately if you breach these terms or if required by law. Upon termination, your right to use the platform ceases and we will handle your data in accordance with our Privacy Policy.
10. Governing Law
These terms are governed by the laws of Brazil. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of Brazil, unless otherwise required by applicable consumer protection law in your jurisdiction.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised terms.
