Terms & Conditions

These terms govern your access to and use of the Construway platform and website. They form the agreement between Construway and the company that subscribes to the service.

1. Acceptance of Terms

By accessing or using Construway, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you may not use our platform or services. These terms apply to all users, including visitors, registered users, and paying subscribers.

These terms are versioned. Platform users see the same terms inside the product and are asked to accept the current version before continuing to use the service; the version identifier at the top of this page matches the version recorded against each acceptance.

2. The Service

Construway is a multi-tenant construction project management service. Each subscribing company holds its own isolated workspace covering projects, schedule, punch list, photo reports, meeting minutes and risk, plus the modules included in its plan. Access to a module depends on the plan contracted by the company.

Construway grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes, subject to these terms.

3. Accounts & Responsibilities

The subscribing company is responsible for the accounts it creates, for the accuracy of the data it enters, and for revoking access when a person leaves. You agree to provide accurate, complete information when registering and to keep it up to date.

Credentials are personal and must not be shared. Accounts with administrative or warehouse authority are required to use two-factor authentication. Each user is responsible for keeping their own authentication factors secure and for promptly notifying us of any unauthorised use.

4. Subscription Term & Renewal

Subscriptions run for an annual term recorded in the contract, with a plan, an active project limit and any contracted add-ons. Renewal, cancellation and changes of plan take effect according to the dates registered in that contract.

5. Payment & Refund

Charges follow the price registered in the contract for the annual term. A refund may be requested within thirty days of the start of the first term. Reactivating a project that was closed during a term may be charged separately.

If payment fails, we may suspend access to paid features until the account is current.

6. Acceptable Use

The service may not be used to store unlawful content, to attempt access to another company's workspace, to probe or circumvent security controls, or to overload the platform through automated access outside the documented interfaces. You also agree not to transmit malware or spam through the platform, or to reverse engineer any part of the software.

7. Ownership of Customer Data

Project content entered or uploaded by a company remains that company's data. Construway processes it to operate the service and to meet legal obligations, as described in the Privacy Policy. Construway does not sell customer data and does not use it to train external models.

The platform software, and the content and technology within it, remain the property of Construway or its licensors. These terms do not grant you any rights in our intellectual property beyond what is explicitly stated.

8. Data & Privacy

Our collection and use of personal data is governed by our Privacy Policy. We process project content as a Data Processor on behalf of your organisation, which acts as the Data Controller. For GDPR-specific information, see our GDPR Compliance page.

9. Export, Termination & Archiving

A company may request an export of its data. The export is produced as an archive made available through a short-lived download link and removed from temporary storage afterwards.

Either party may terminate the agreement at any time, and we may suspend or terminate access if you breach these terms or if required by law. On termination, the workspace is closed and the data is deleted within the period stated in the contract, except for records that must be retained as evidence or to satisfy a legal obligation.

10. Availability & Support

Construway aims to keep the service available and to apply security updates, but availability commitments and support response times are only those written into the contract. Planned maintenance may interrupt access.

11. Limitation of Liability

The service supports construction management decisions but does not replace professional engineering judgement, technical inspection or legal review. Documents, certificates and reports generated by the platform record what users entered and approved; they are not an independent technical opinion.

Construway's liability is limited to the extent written into the contract and permitted by law. To the fullest extent permitted by law, Construway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.

12. Security Incidents

If Construway becomes aware of a security incident affecting a company's personal data, it will notify that company's registered administrator with the information available, in line with LGPD art. 48.

13. Changes to These Terms

These terms are versioned. When a new version is published, users are asked to accept it before continuing to use the service, and each acceptance is recorded with its version, timestamp and originating address. We will also notify you of material changes by email or through the platform.

14. Governing Law

These terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the Brazilian courts, unless otherwise required by applicable consumer protection law in your jurisdiction.
